When you ask for a rate quotation, we may obtain credit information if permitted by applicable state law. Our sales and service representatives do not have access to the details of your credit information. Other companies who view your credit report will not see the USAccidentClaims inquiry. It will be visible only to you. Our inquiry will not affect your credit score or credit rating. If you commit to purchase a policy with USAccidentClaims, we will also confirm your motor vehicle record and claims history. As permitted by law, we may also review your motor vehicle record, claims history, and/or credit information in connection with any renewal. LOCATION SERVICES Your current location is only used if you permit our services to do so. If you allow your location to be obtained using a USAccidentClaims app, or with a browser, we will use this information to return your estimated location. We use this information solely to distinguish your current location and not to identify you. USAccidentClaims does not automatically track your location. ACCESS TO AND CORRECTION OF PERSONAL INFORMATION If you are a resident of Arizona, California, Connecticut, Georgia, Illinois, Maine, Minnesota, Montana, Nevada, New Jersey, North Carolina, Oregon, or Virginia, you have the right to request access to and correction of the personal information that we have collected from or about you. An antifraud service provider may confirm the information a consumer has provided to us and give us additional personal identifiers in response. Driving and claims history, including information about any prior accidents or insurance claims. We request this information directly from consumers, but also sometimes receive it from antifraud and risk-assessment service providers.
Vehicle information, such as a vehicle identification number (VIN), vehicle details, including any customizations, and vehicle photos. We collect this information directly from consumers, claimants, auto dealerships, body shops, and other service providers.
Financial identifiers, such as a bank account number, credit card number, debit card number, or other financial information. We generally collect this information directly from consumers. On occasion, we may receive this information indirectly while handling claims.
Medical information, such as details involving the injuries sustained in a car accident, the treatment for such injuries, as well as health insurance information. We receive this information either directly from consumers or their attorneys, or from medical-field third-parties, in accordance with state and federal law.
Commercial information about consumer transactions and experiences with us and others, such as payment history, claims, coverage and vehicle changes. We may receive this information directly from consumers or through their online activities, and sometimes from third-party vendors.

We receive this information directly from consumers or a claimant’s insurer, through police investigations (i.e. accident reports), and through fraud investigations.
Professional or employment-related information in the form of business contact information and education or employment history, which we only use as permitted by law. We generally collect this information directly from consumers. On occasion, this information is provided to us by third-parties.
Applicant and Employee information, in addition to information in the above categories, this information includes birth certificates (to validate dependents), passport numbers, access badge photos, background and screening data, and protected class characteristics. This information is used in accordance with state and federal laws and is shared with our human-resources service providers.
Inferences drawn from the information we collect when consumers visit our websites, use our mobile apps, or interact with us on our social media platforms, as well as information about consumer preferences and behavior that we collect on our websites and mobile apps.

ARBITRATION AGREEMENT
Any dispute or claim relating in any way to your use of this website, including any related calls texts or other communications, will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. This includes claims against our clients, vendors, and Marketing Partners, which are third party beneficiaries, of the arbitration agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited. Or even when you’re one of its customers, and need to file a claim.

How Soon Should I Make A Claim?

Although you usually have three years after the date of an accident to make a claim for compensation, it’s a good idea to contact a solicitor as soon as possible.

Contacting a law firm early means the investigation of your accident can get underway while memories of the incident are still fresh in the minds of all involved.

There are some exceptions to the three year time limit for making a claim. They are:

  • Mental Capacity – if a loved one lacks the capacity to make a claim themselves, there is no time limit for making a claim on their behalf.
  • Children – claims can be made at any point before your child turns 18. After that, your child can make a claim up until the age of 21.
  • Road Traffic Accidents Abroad – time limits in other countries can be shorter than in the UK. However, depending on the circumstances of your accident, you may still be able to make a claim under UK law.
  • Criminal Injuries – in cases where your injuries were caused by a deliberate act, a claim can also be made through the Criminal Injury Compensation Authority. However, in these cases a time limit of two years applies from the date of the incident.
